FAYETTEVILLE, N.C. - The Fayetteville City Council met June 24 at 6:30 p.m. in the City Hall Council Chambers to discuss matters relevant to the city. 

The meeting was called to order at 6:45 p.m., followed by the invocation given by Lionell Cartwright from Power of Christian Faith Church, and the Pledge of Allegiance led by Mayor Mitch Colvin and City Council. 

Three ANNOUNCEMENTS AND RECOGNITIONS were made during the meeting.  

  • Mayor Colvin presented a proclamation to Fayetteville Pride President, Ms. Krystal Maddox in honor of Pride Month. 
  • Mayor Colvin read a proclamation in honor of Juneteenth. 
  • Mayor Pro Tem Jensen presented a proclamation in honor of Women Veteran’s Month.  

During the CITY MANAGER’S REPORT, City Manager Douglas J. Hewett stated the City Manager newsletter is published weekly and residents can sign up to receive it via the city’s website. 

Councilmember Benavente moved to APPROVE THE AGENDA with the exception of Item 7.0A14 which would be moved and discussed during 7.0B. Councilmember Courtney Banks-McLaughlin seconded the motion. It was APPROVED unanimously (10-0).   

The CONSENT AGENDA is a group of items that are considered routine whereby all items are passed with a single motion and vote. Councilmember Benavente moved to approve the 13 CONSENT AGENDA items. Councilmember Derrek Thompson seconded the motion.  It was APPROVED unanimously (10-0).

Councilmember Benavente moved to approve the request for Legal Representation of City Employees. Councilmember Lynne Greene seconded the motion. It was APPROVED unanimously (10-0).  

Councilmember Benavente moved to direct City staff to reach out to appropriate partnerships and establish a sentinel review process, seconded by Councilmember Banks-McLaughlin. The motion PASSED (7-3). Those voting in OPPOSITION were Mayor Pro Tem Kathy Jensen, Councilmembers D.J. Haire and Thompson. 

For certain issues, the Fayetteville City Council may sit as a quasi -judicial body that has powers resembling those of a court of law or judge. The Council will hold hearings, investigate facts, weigh evidence and draw conclusions which serve as a basis for its decisions. All persons wishing to appear before the Council should be prepared to give sworn testimony on relevant facts. The PUBLIC HEARINGS (Public & Legislative Hearing) included the following: 

The first public hearing was AX24-01: Judd Brook 6, LLC petitioned to be annexed into the corporate limits of the City of Fayetteville of one non-contiguous parcel totaling 3.51 ± acres.  This parcel is located north of NC HWY 24 on the corner of Whitehead Road and NC HWY 24 at 2246 Angelia M Street and can be further identified by PIN #: 0447-92-7785, and REID# 0447927785.  One person spoke in favor of the item. Councilmember Malik Davis moved to adopt the annexation ordinance of Judd Brook 6, LLC into the corporate limits of the City of Fayetteville with an effective date of June 24, 2024. Councilmember Banks-McLaughlin seconded the motion. It was APPROVED unanimously (10-0). 

The second public hearing was TA24-10, proposed amendments to the Hospital Area Overlay and Plans. Two people spoke in favor of the item. There were no speakers in opposition. You can learn more about this item here. 

Councilmember Greene moved to approve the proposed amendments to the Hospital Area Overlay and Plan. Councilmember Davis seconded the motion. It was APPROVED unanimously (10-0). 

The third public hearing was P24-22, the Initial map amendment from Rural Residential (RR) (County) to Mixed Residential 5 Conditional (MR-5/CZ) located at 1666 & 1674 Cedar Creek Rd and 1678 & unaddressed parcel Fields Rd (REID #s 0446709250000, 0446804556000, 0445894268000, 0445892478000) totaling 27.72 acres ± and being the property of Cedar Creek Road, LLC. Three people spoke in favor. Five spoke in opposition. You can learn more about this item here

Councilmember Hondros moved to recuse Mayor Colvin from Items 8.03 and 8.04. Councilmember Thompson seconded the motion. The motion was APPROVED unanimously (9-0).  

Councilmember Hondros moved to recuse Councilmember Greene from Items 8.03 and 8.04. Councilmember Davis seconded the motion. The motion was APPROVED unanimously (8-0).  

Councilmember Hondros moved to approve the map amendment to MR-5/CZ as presented based on the evidence submitted and finds that the map amendment and rezoning was consistent with the plan of the City as demonstrated by the attached consistency and reasonableness statement with an update to the Land Use Plan to reflect this map amendment. Councilmember Haire seconded the motion. The motion PASSED (5-3). Those voting in OPPOSITION were Councilmembers Davis, Benavente and McNair. 

The final public hearing was AX24-02. Cedar Creek Road, LLC petitioned to annex into the corporate limits of the City of Fayetteville four contiguous parcels totaling 27.72 ± acres.  These parcels are located on the western side of Cedar Creek Road at 1666 and 1674 Cedar Creek Road, and 0 and 1678 Fields Road, and can be further identified by PIN #’s: 0556-89-2478 0446-70-9250, 0446-80-4556, and 0445-89-4268, and REID#’s: 0445892478000, 0446709250000, 0446804556000, and 0445894268000. Councilmember Davis moved to adopt the annexation ordinance with an effective date of June 24, 2024. Councilmember Hondros seconded the motion. It was APPROVED unanimously (8-0). 

OTHER ITEMS OF BUSINESS included the Fiscal Year 2025 Budget Ordinance, Adoption of the FY 2025 Fee Schedule, FY 2025 Capital Project Ordinances and Amendments, and FY 2025 Special Revenue Fund Ordinance Amendment. 

Councilmember Thompson moved to adopt the proposed FY 2025 Budget Ordinance documents including FY 2025 Budget Ordinance, FY 2025 Fee Schedule, FY 2025 Capital Project Ordinances and Amendments, and FY 2025 Special Revenue Fund Ordinance Amendment as presented. Councilmember Haire seconded the motion. It was APPROVED unanimously (10-0). You can learn more about this item here. 

ADMINISTRATIVE REPORTS on a Regular Meeting agenda are for City Council review and information only.
